These Terms and Conditions (the "Terms and Conditions") set out the rules for the provision of the services of publishing comments electronically by means of the website located at whitepress.com (hereinafter: the "Website") for the benefit of Internet end-users visiting the Website, who complete all legal and factual actions provided for in the Terms and Conditions, and at the same time are Users within the meaning of point. 1.3 of the Terms and Conditions below (hereinafter: "Users").
The Services are provided by "WhitePress" Spółka z ograniczoną odpowiedzialnością, with its registered office in Bielsko-Biała at Legionów 26/28, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court in Bielsko - Biała, 8th Economic Division of the National Court Register under the KRS number: 0000651339, NIP: 9372667797, REGON: 243400145 and other companies from the WhitePress Group (hereinafter collectively referred to as: Website Provider).
A "User" is understood to be any person visiting and using the Website who, after accepting the provisions of the Terms and Conditions, completes the procedure for publishing a comment, ending with the effective publication of the comment on the Website.
The Terms and Conditions for adding comments on the Website specify the Terms and Conditions under which the User may use the Website provided electronically to add comments under articles published on the Website, as well as the Terms and Conditions for submitting comments and the cases in which the Website Provider is entitled to delete them.
The user who publishes comments at the same time declares that he/she accepts the conditions specified in these Terms and Conditions and undertakes to comply with the obligations arising from these Terms and Conditions.
Comments publishing
The procedure for publishing comments consists of filling in an electronic form, accepting the Terms and Conditions and agreeing to the scope indicated by the Website Provider and the rules of data processing provided for in the Website Privacy Policy.
The user has the option of publishing comments either anonymously, under a pseudonym or under his or her own name.
It is prohibited for the User to publish comments which:
are illegal under the Digital Services Act (“DSA”);
are used to advertise goods, services, content or digital services;
are used to carry out activities prohibited by law, such as attempted fraud or extortion;
incite or advocate violence against any living creature, including animals;
incite or praise dangerous behaviour;
promote any fascist or other totalitarian state system;
incite or advocate hatred based on differences of gender, sex, nationality, ethnicity, race, religion or irreligion;
insult a group of people or individuals because of their national, ethnic, racial, religious, gender, sexual or any other reason;
defame or insult any individual;
may cause discomfort to others, in particular by lacking empathy or respect for others;
contain vulgarities or other content of an offensive nature.
Only content (contributions) of the User's own authorship may be distributed via comments.
If third-party content is quoted or referred to in a comment, the User is obliged to identify the real author of the content and the source of the content.
In the event that the Website Provider becomes aware of any information giving rise to a suspicion that a criminal offence has been, is being or may be committed in connection with the User's comments, the Website Provider shall immediately inform the law enforcement authorities or judicial authorities of its suspicion and pass all available information on to the relevant authorities.
The Website Provider conducts comment screening activities to detect illegal or non-compliant comments.
The User, in the cases referred to in point 2.3. of these Terms and Conditions and in other cases in which the User believes that the law or good manners may have been breached, may report to the Website Provider a comment appearing on the Website by clicking on the "Report comment" button, which is visible next to each published comment.
The Website Provider shall consider all submissions and make a decision with regard to the submitted comment within 14 days of receipt of the submission, in an arbitrary, objective manner and with due diligence.
If an illegal or non-compliant comment is detected, the Website Provider shall remove the comment, leaving a notice on the Website that the comment has been removed.
Appeals
Any decision by the Website Provider to remove a comment may be appealed by the User in the manner provided for in section 3.2 below.
The appeal can be submitted via email available in the “contact” section on the Website, within 14 days of acknowledgement that a comment published by the User has been removed.
The appeal referred to in paragraph 3.2 above should contain the email address of the appellant, the content of the published comment in connection with the removal of which the appeal is made, the date and time of the event which is the subject of the appeal and a comprehensive explanation of why the User making the appeal disagrees with the Website Provider's decision to remove the comment.
Appeals will be considered within 14 days after receipt, in order of the date of receipt. The Website Provider shall consider appeals in an arbitrary manner, nevertheless making an objective assessment of each specific case, taking into account the interests of Internet users and the principles of social justice. The Website Provider's decision is final.
The User will be informed by the Website Provider of the outcome of the appeal by email to the email address provided in the User's appeal.
Final provisions
The Website Provider is not responsible for the content of Users' statements published in comments on the Website.
The user who publishes a comment is solely and personally liable for the statements he/she makes that violate the law or these Terms and Conditions.
The Website Provider reserves the right to disclose the User's data in its possession at the request of an authorised state authority in the event of criminal or civil proceedings relating to the User's activity on the Website Provider's Website
In matters not covered by these Terms and Conditions, the provisions of Polish law shall apply.
Any disputes between the User and the Website Provider will be resolved amicably and, in the absence of an agreement, will be referred to the court having jurisdiction over the Website Provider's registered office.
