Digital PR Service Regulations

  1. General provisions
    1. These Regulations define the terms and conditions of using the Digital PR service offered by WhitePress. Sp. z o.o. with its registered office in Bielsko-Biała (43-300), 26/28 Legionów Street, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court in Bielsko-Biała, 8th Economic Division of the National Court Register, under the KRS number 0000651339, NIP: 9372667797, REGON: 243400145.
       
    2. Unless otherwise stated herein, the capitalised terms listed below shall have the following meanings:

      Anchor - a phrase or name under which a Link directing to the Advertiser's website is placed, chosen by the Service Provider.

      Digital PR - a service consisting of the acquisition of publications with Links (backlinks), according to the assumptions and specifications set out in the offer selected by the Advertiser, available on the Platform.

      Business day - any day of the week from Monday to Friday, excluding public holidays in Poland within the meaning of the Act on Public Holidays of 18 January 1951.

      Link - a reference directing to the URL of a website (domain) indicated by an Advertiser at the stage of placing an order for the Digital PR Service, whereas a Link obtained within the Service may be a Link directing to any URL (e.g. a subpage) within the indicated main domain of an Advertiser. Publication of a Link takes place within an existing or newly created content (article) on the Portal.

      Fee - the fee paid by the Advertiser to the Service Provider for the requested Service in accordance with the price list published on the Platform.

      Platform - the website owned and provided by the Service Provider at: whitepress.com.

      Portal - a web portal or blog selected by the Service Provider for the performance of the Service. The Portal is selected on the basis of the parameters specified in the offer selected by the Advertiser and the order placed, as well as using the relevant SEO criteria; the Service Provider decides on the selection of the Portal each time.

      Regulations - these Regulations specifying the conditions of use of the Digital PR Service by an Advertiser.

      Advertiser's terms and Conditions - a document regulating the conditions of using the Platform and ordering services made available within the Platform by Advertisers, available HERE.

      Complaint - the procedure by which the Claimant makes a claim related to the cases specified in clause. 2.8 of the Regulations.

      Advertiser - a User of the Platform who is an entrepreneur, whose situation is governed by the Advertiser Regulations.

      Contract - a contract for the provision of Services by the Service Provider to the Advertiser, concluded between the Advertiser and the Service Provider, under the terms and conditions set out in these Regulations.

      Service - Digital PR service.

      Service Provider - WhitePress sp. z o.o. with its registered office in Bielsko-Biała, ul. Legionów 26/28, 43-300 Bielsko-Biała, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court in Bielsko-Biała, 8th Economic Division of the National Court Register, under the KRS number: 0000651339, NIP: 9372667797, REGON: 243400145.

       
    3. The Service Provider provides electronic services to the Users of the Platform on the basis of agreements concluded at a distance between the User and the Service Provider. These Regulations constitute the regulations for the provision of services by electronic means referred to in Article 8 of the Act of 18 July 2002 on the provision of services by electronic means.
       
    4. The conclusion of a contract for the provision of the Service is possible provided that you have a PC, Mac or similar computer connected to the Internet, equipped with an operating system (Windows, Mac OS, Linux or similar) and a web browser (Internet Explorer, Firefox, Chrome, Opera, Safari), as well as access to an email account.
       
    5. The Service Provider is entitled to carry out the Services through subcontractors. In this case, direct contact is possible between the subcontractor acting on behalf of the Service Provider and the Advertiser, within the scope and for the purpose of the correct execution of the requested Service.
       
    6. To the extent not covered by these Terms and Conditions and to the extent that they do not conflict with these Terms and Conditions, the provisions of the Advertiser's Terms and Conditions shall apply accordingly.
       
    7. The Services provided by the Service Provider under the Terms and Conditions are intended for persons who use the Services for the purposes of their own business and, at the same time, are of a professional nature for them. Whenever a User who is a consumer or an entrepreneur for whom the use of the Services provided by the Service Provider is not of a professional nature (the so-called quasi-entrepreneur) wishes to use the Services provided by the Service Provider under the Regulations, contracts with regard to the Services provided by the Service Provider by electronic means shall be concluded with him/her on individually agreed terms, with the reservation that the provisions of the Regulations and the documents to which the Regulations refer shall apply to such Advertiser with regard to prices and, depending on individual arrangements, respectively with regard to the rest.
       
  2. Conditions for ordering and providing the Service
    1. As part of the Platform functionality, the Service Provider generates offers to purchase the Service, including at least the following information:  
      • thematic category;
      • Link parameters (e.g.: DR value range, number of links to be acquired, percentage level of dofollow links)
      • deadline for completion of the Service;
      • the purchase price of the Service.

    2. The Advertiser is required to provide the Service Provider with the following data at the order creation stage:
      • personal data of the author of the statement/expert comment;
      • a statement on the conformity of expression and consent to its use;
      • optional: exclusion of the thematic categories under which the Service is to be provided.
       
    3. The Advertiser can select a Premium option that is linked to the chosen subject categories. The Advertiser can see the currently available Premium options at the ordering stage. The Service Provider has the right to change the subject category offered as a Premium option at any time and at its own discretion. In the event that the selected offer is not marked as a Premium option, but the thematicity of the Links belongs to the thematic category in the Premium option, the Service Provider will inform the Advertiser of this. The Advertiser may cancel the order for the Service or cover the price difference according to the current price list.
       
    4. The conclusion of the contract between the Advertiser and the Service Provider for the performance of the Service takes place when the Service Provider accepts the order placed on the basis of the selected offer. The conclusion of the contract and its terms and conditions are subject to recording by means of an email sent to the Advertiser within the functionality of the Platform.
       
    5. The Service is provided within the timeframe specified in the offer. The Advertiser has the right to add comments to the submitted order, however, these comments are only treated as informative and do not constitute guidelines for the performance of the Service.
       
    6. By placing an order, the Advertiser declares that he/she acknowledges that he/she has no influence on the content of the publication containing the Link, the selected Anchor and the Portal on which the publication with the Link is executed.
       
    7. Once the Service has been provided, the Service Provider will mark the fact that the Service has been provided as part of the functionality of the Platform. “Marking” in the above sense is understood to be the fact that information about the place of publication of the Link (publication URL) and a screen shot from the Ahrefs tool showing the DR metric of the Link are placed within the Platform. Marking has the effect of automatically notifying the Advertiser via the Platform or sending information to the Advertiser by email about the implementation of the Service. At the moment of marking in the above sense, the Service is considered to have been realised.
       
    8. As part of the verification of the performance of the Service, the advertiser has the right - within 3 days of the marking - to raise a Complaint (objection) to the performance of the Service only in the following cases:
      1. the publication contains illegal content;
      2. the publication contains content which is incompatible with good morals and raises justified ethical questions;

      Complaints shall be submitted in accordance with the procedure described in point 5 of the Regulations.

       
    9. The Service Provider does not guarantee any period of availability of the Link on the Portal, understood both as the visibility of the Link in the publication and the maintenance of unchanged parameters (dofollow / nofollow). Due to the type and nature of the Service provided, in the event of the unavailability of a Link at any time after the implementation of the Service, the Advertiser is not entitled to any claim against the Service Provider.
       
    10. The Advertiser is not authorised to use the Digital PR service for the purpose of conducting advertising of products or services, the advertising and promotion of which is prohibited pursuant to the generally applicable provisions of law, such as, among others: gambling games, alcoholic beverages and tobacco products, psychoactive substances, narcotic drugs, medications and other pharmaceutical products, services of sale, purchase or intermediation in the transaction of sale or purchase of cells, tissues and organs, medical services, services of attorneys at law, notaries public and other professional groups subject to the prohibition on advertising. In the event of a breach by the Advertiser of the provisions of this point 2.10, the provisions of the Advertiser's Terms and Conditions shall apply accordingly.
       
  3. Contract
    1. The Advertiser purchases the Service at the order placement stage through the relevant functionality of the Platform in the Digital PR service module.
       
    2. Upon the purchase of the Service by the Advertiser, a Contract is concluded between the Advertiser and the Service Provider under the terms and conditions set out in these Regulations.
       
    3. As part of the Platform's functionality, the Advertiser is able to view, filter and manage the orders placed.
       
    4. The Service Provider may refuse to fulfil the order. The Service Provider shall each time indicate to the Advertiser the reason for the refusal of the order.
       
  4. Amount of the Charge
    1. The service is chargeable.
       
    2. The amount of the Charge is determined by the Service Provider and is based on the respective offer.
    3. The amount of the Charge is visible to the Advertiser on the Platform at the ordering stage.
       
    4. To the extent not covered by these Terms and Conditions, the provisions of the Advertiser's Terms and Conditions shall apply mutatis mutandis to the Charge, including the payment terms.
       
  5. Complaints
    1. In the case referred to in point 2.8 of the Terms and Conditions, the Advertiser has the right to submit a Complaint to the Service Provider.
       
    2. Submitting a Complaint is done by sending an email with a description of the Complaint to  .
       
    3. Complaints are dealt with by the Service Provider, within 30 working days of notification.
       
    4. If the Complaint is upheld, the Service Provider re-publishes the Service, i.e. republishes the Link (although it may change its location while maintaining the parameters described in the order).
       
  6. Responsibility
    1. The Service Provider is liable to the Advertiser for lack of due diligence in connection with the performance of the Service. The Service Provider's liability shall each time be limited to the amount corresponding to the Fee paid by the Advertiser to the Service Provider for the Service ordered and not performed or not performed properly.
       
    2. The Service Provider shall not be liable for damages caused by improper use of the Service, in particular caused by the User's use of the Service in a manner inconsistent with the provisions of these Regulations.
       
    3. The Service Provider shall not be liable for the non-performance or improper performance of the Service or for problems in the use of the Digital PR module if these occur as a result of events which the Service Provider, in the exercise of due diligence, could not have foreseen or prevented, or as a result of fortuitous events or force majeure.
       
    4. The Service Provider is not responsible for the content, content value, legality and reality (facts) of the Portal to which the Link refers.
       
    5. To the extent not covered by this point 7 of the Regulations, the provisions of point 13 of the Advertiser's Terms and Conditions apply.
       
    6. The Advertiser hereby consents to the Service Provider transferring to third parties the rights or obligations arising from the Terms and Conditions or the contract concluded in the performance of the Terms and Conditions.
       
  7. Final provisions
    1. In matters not regulated in these Regulations, including complaints concerning the provision of services by electronic means, the provisions of the Advertiser's Terms and Conditions and the provisions of Polish law shall apply accordingly.
       
    2. In justified cases, the Service Provider is entitled to contact the Advertiser in order to confirm or clarify the content of the order or the information indicated within the order (including in order to agree on the content of the expert statement).
       
    3. Any disputes between the Advertiser and the Service Provider will be resolved amicably and, if no agreement is reached, will be referred to the court having jurisdiction over the Service Provider's registered office.
       
    4. The Service Provider has the right to make changes to these Regulations for valid reasons. The Advertiser will be informed of changes to the Regulations at least 7 days in advance by sending information about the change to his/her e-mail address provided within the Advertiser's account on the Platform.
       
    5. By placing an order for the Service, the Advertiser declares that it has read these Regulations and accepts their contents.
       
    6. The Regulations enter into force on ...
