WhitePress® "Website Booster" Service Terms and Conditions

  1. General provisions
    1. These Terms and Conditions define the terms and conditions of the Website Booster service, consisting of highlighting on the list of portals displayed to Advertisers on the WhitePress Platform, offered by the WhitePress Group®. The Service Provider is the company with which the User is bound by a contract for the provision of electronic services, as indicated in the relevant WhitePress Platform Terms and Conditions, which were accepted by the User at the stage of account registration in the Platform (hereinafter as “WhitePress”).
       
    2. Unless otherwise stated herein, the capitalised terms listed below shall have the following meanings:

      Business day – any day of the week from Monday to Friday, excluding public holidays according to the legislation in force.

      Website Booster – a service consisting in the temporary, rotating display of Publishers' Portals, for which the service has been purchased, in the top 5 of Portals visible to Advertisers on the list of Portals in the category for which the Website Booster service has been purchased; in these Regulations, the service is also referred to as "highlighting".

      Portal – an Internet portal or blog belonging to a Publisher, the surface of which is offered by the Publisher within the Platform to be made available for the publication of articles ordered by Advertisers, in accordance with the relevant provisions of the
      Terms and Conditions for Publishers.

      WhitePress Platform or Platform – the website owned and provided by WhitePress, available at whitepress.com.

      Terms and Conditions – these Terms and Conditions specifying the terms and conditions of the Website Booster service provided by WhitePress.

      Advertiser – a User of the Platform who is an entrepreneur whose situation is governed by the Terms and Conditions for Advertiser.

      Calendar week / full week – a period of 7 (seven) consecutive days, beginning on Monday at 00:00:00 and ending on Sunday at 23:59:59.

      Incomplete week – a period of any number of consecutive days, commencing on any day of the week other than Monday, at any time or on Monday, provided that the order is placed from the current day and ending on the nearest Sunday following that day of the week at 23:59:59.

      Contract – a contract for the provision of the Website Booster service, concluded between the Publisher and WhitePress, under the terms and conditions set out in these Terms and Conditions.

      User – an end user of the Internet, visiting the Platform.

      WhitePress – WhitePress Publishing LTD (United Kingdom) a limited liability company with its registered office in the United Kingdom, with registered office at 590 Kingston Road, SW20 8DN London, United Kingdom, registered under the entry number: 12339845, TAX ID No.: 348918847

      Publisher – A Platform User who is an entrepreneur whose situation is governed by the Terms and Conditions for Publishers.
       
    3. WhitePress provides electronic services to Platform Users on the basis of distance agreements between the User and WhitePress. These Terms and Conditions constitute the terms and conditions for the provision of electronic services according to the legislation in force.
       
    4. The use of the services provided by WhitePress, referred to in point 3 above, is possible on the condition of having a PC, Mac or similar computer connected to the Internet, equipped with an operating system (Windows, Mac OS, Linux or similar) and a web browser (Internet Explorer, Firefox, Chrome, Opera, Safari), as well as access to an e-mail account.
       
    5. To the extent not covered by these Terms and Conditions, the provisions of the Terms and Conditions for Publishers shall apply accordingly.
       
    6. The services provided by WhitePress under the Terms and Conditions are intended for people who use these services for their own business purposes and, at the same time, they are of a professional nature for them. Whenever the services provided by WhitePress under the Terms and Conditions are to be used by a User who is a consumer or an entrepreneur for whom the use of the services provided by WhitePress is not of a professional nature (the so-called quasi-entrepreneur), the agreements on the services provided by WhitePress electronically shall be concluded with them on terms and conditions agreed individually, with the reservation that the provisions of the Terms and Conditions and the documents to which the Terms and Conditions refer shall be applicable to such a User in terms of prices and, depending on individual arrangements, in other respects respectively.
       
  2. Website Booster service for Publisher Portals in WhitePress
    1. TThe Website Booster service consists in enabling the Publisher to purchase a paid option to highlight a chosen Portal, for which the service has been purchased, in a category chosen by the Publisher and for a period chosen by the Publisher.
       
    2. The period of Website Booster service available for purchase in a single Website Booster order is one calendar week or a multiple thereof, but no more than 4 (four) full weeks at a time.
       
    3. The award period is calculated in calendar weeks and starts on Monday at 00:00:00 and ends on Sunday at 23:59:59. The publisher also has the option of purchasing an award in the current period for a partial week, starting on a day other than Monday or on Monday if the order is placed from the current day, whereby the period is counted as a full week for billing purposes.
       
    4. A Portal may be highlighted in at least one category. Each category under which a Publisher orders a Portal to be highlighted is counted as one order of Website Booster service for the given Portal, subject to payment according to the price list made available to the Publisher within the functionalities of the WhitePress Platform.
       
    5. The Publisher may purchase the Website Booster service for the Portal under the same or a different category than the category to which the Portal belongs according to the accepted designation of the Portal's subject matter.
       
    6. The Publisher's Portal for which the Website Booster service has been purchased will be displayed temporarily, on a rotating basis, in the top 5 Portals visible in the list of Portals for a given category - depending on the category for which the service has been purchased for the Portal, subject to points 7 - 9 below.
       
    7. The Service Provider sets a limit of up to 20 (twenty) Portals that take part in the rotating distinction within the first 5 (five) positions on the list of Portals displayed to Advertisers within a category and within a weekly period.
       
    8. The rotation in the list of offers is carried out automatically, each time the list of offers of the Portal is displayed by any User of the Platform.
       
    9. The Service Provider does not guarantee the distinction of the Publisher's Portal in a specific position of the first 5 (five) positions of the list, nor does it guarantee a specific number of displays of the Portal within the first 5 (five) positions of the list within the duration of the highlighting, which means that during the period for which the Website Booster service has been purchased, the Publisher's Portal will be displayed temporarily and automatically within the first 5 (five) positions any number of times.
       
    10. A Portal for which a Website Booster service has been purchased will be displayed on the list of Portals regardless of whether the Advertiser to whom the view of highlighted Portals is displayed has previously purchased a publication on it or whether it is in the process of being published. In the cases referred to in the preceding sentence, an appropriate notification will appear in the view of this Advertiser next to the highlighted Portal
       
    11. In case in which the Advertiser displaying the list of Portals does not select any filters (including categories), i.e. in the main view of the search engine for offers on the Platform, all Portals for which the Website Booster service has been purchased will be displayed. In this case, the main view of the search engine should be treated as if all subject categories had been selected.
       
    12. If the Advertiser selects a category for the displayed list of Portals, the Portal covered by the Website Booster service will be displayed for a given thematic category, which means that if a specific category is selected by the Advertiser, Portals for which the Website Booster service has been purchased in a category other than the one selected by the Advertiser at the filter level will not be displayed as highlighted in his/her view on a rotating basis.
       
    13. A Portal covered by the Website Booster service will be displayed on the list of highlighted Portals in a rotating system also in the event that not all parameters of the Portal are in accordance with the filters used by the Advertiser. The only filter determining display within highlighted Portals will be the Portal category (subject matter), subject to point 14 below.
       
    14. The following exceptions to the rule set out in point 13 are permitted:
      • the Portal will not be highlighted within the Advertiser view if the filters are selected: "dofollow links" and "price from" if it does not meet the specified criteria;
      • the Portal will not be highlighted within the Advertiser view in case of selection of the "favourites" or "own list" filters or enter the exact URL using inverted commas in the "Portal name" field;
      • Portals with a purchased Website Booster service will not be displayed as highlighted to an Advertiser who acts as both Publisher and Advertiser and purchases the service for their own Portals.
       
    15. The Publisher has the option to purchase the Website Booster service for the Portal in part or full calendar weeks, for a maximum of 4 (four) full calendar weeks in one order.
       
    16. As part of the relevant functionality of the Publisher's Platform, a calendar is made available to the Publisher showing the next 4 (four) full calendar weeks within which the Publisher can purchase the Website Booster service for the selected Portal at any given time. Reservations open every Monday at 00:00:00.
       
    17. If a Publisher selects a thematic category for the Website Booster service, in which the limit of 20 (twenty) Portals is reached in the period selected by the Publisher, the Publisher will not be able to purchase the service with the specified parameters (category and period of highlighting). In order to purchase the service, the Publisher will have to modify the order - indicate a different thematic category or a different period of highlighting for the chosen Portal.
       
  3. Website Booster service fees
    1. The Website Booster service is chargeable.
       
    2. The amount of the service fee is visible to the Publisher in the "Website Booster" module of the Publisher's account on the Platform.
       
    3. The fee is set as a lump sum for a minimum award period of 1 (one) calendar week.
       
    4. The Publisher may also purchase the service for the current calendar week, irrespective of the day on which the booking is made, i.e. purchase the service for an incomplete week.
       
    5. In case referred to in point 4 above, the Publisher is obliged to pay for the service ordered for a part-week period in the same way as for a full week.
       
    6. In order to place an order for the Website Booster service, once all the required parameters have been defined within the functionality of the Platform, the Publisher is obliged to make a payment to the Service Provider in the manner provided for in the Platform.
       
    7. Adding the configured Website Booster service to the basket on the Publisher's account on the Platform does not imply reservation of the service. The limit of 20 (twenty) places on the highlighted list within a given category is verified at the time of payment by the Publisher.
       
    8. The Publisher may make payment for the service in the following form:
      • payment with funds held in the Publisher's account on the Platform;
      • quick payment via PayU or PayPal.
       
    9. In case of selecting PayU or PayPal fast payment option, failure to process the payment within 24 hours of going to the payment service on the Platform will result in cancellation of the service order.
       
    10. The provision of the Website Booster service shall commence on the date indicated by the Publisher, but no sooner than when the payment for the service has been credited by the Service Provider.
       
  4. Website Booster service resignation or withdrawal
    1. Publishers who have purchased the Website Booster service for a given Portal have the right to withdraw from this agreement no later than 1 (one) day before the start of the service.
       
    2. The wish to withdraw from the Website Booster service is declared by the Publisher by indicating the corresponding status within the functionalities of the Platform made available to him.
       
    3. In the event of an effective withdrawal by a Publisher, the Service Provider will refund the funds with which the Publisher paid for the order for the Website Booster service within 3 (three) working days. The refund will be made exclusively to the Publisher's account on the Platform, irrespective of how the order was paid for.
       
    4. Throughout the duration of the Website Booster service for a given Website, the Publisher has the right to resign from the service. Resignation from the service by the Publisher during its duration does not result in the obligation of the Service Provider to refund the Website Booster service fee, which means that in the event of resignation from the service after its commencement, the Publisher does not have the right to demand a refund of the service fee from the Service Provider.
       
  5. Statistic
    1. The Service Provider, as part of the Website Booster service, provides the Publisher with statistics from the campaign purchased by the Publisher.
       
    2. The statistics referred to in point 1 above are available to the Publisher during the running of the campaign and after its completion.
       
    3. Campaign statistics include the following:
      • the number of views of the Portal covered by the Website Booster service:
        • within the main view of the search engine (without filters), and
        • within the search engine view using a filter per subject category;
      • number of hits on the list of offers on the highlighted Portal;
      • the number of offers purchased from the highlighted Portal during the campaign period;
      • Publisher's revenue from offers purchased from the highlighted Portal during the campaign period.
       
    4. Statistics will be displayed for the period of each calendar week and as a summary of the entire Website Booster campaign for a given Portal.
       
    5. The statistics are made available to the Publisher free of charge.
       
  6. Responsibility
    1. The Service Provider shall be liable to the Publisher for failure to exercise due diligence in connection with the provision of the services. The Service Provider's liability in each case is limited to the amount corresponding to the fee paid by the Publisher to the Service Provider for services ordered and not rendered or not rendered properly.
       
    2. The Service Provider shall not be liable for damages caused by incorrect use of the service, in particular caused by the User's use of the service in a manner inconsistent with the provisions of these Terms and Conditions.
       
    3. The Service Provider shall not be liable for non-performance or improper performance of the service or for problems in the use of the Platform functionality dedicated to the service, if these occur as a result of events which the Service Provider, in the exercise of due diligence, could not have foreseen or prevented, as well as due to fortuitous events or force majeure.
       
    4. The Service Provider does not guarantee the Publisher any specific results in connection with the use of the Website Booster service, in particular it does not guarantee an increase in revenue from orders for publications on the Portal for which the service has been purchased.
       
  7. Complaint procedure for the provision of electronic services
    1. All complaints concerning the provision of electronic services by the Service Provider under these Terms and Conditions should be made by e-mail, to: uk@whitepress.com.
       
    2. The complaint should include at least: the date and time of the event that is the subject of the complaint, the e-mail address of the complainant and a brief description of the objections raised.
       
    3. Complaints will be processed within 14 days of receipt, in order of date of receipt.
       
    4. If it is not possible to meet the aforementioned deadline, the Service Provider shall inform the person making the complaint, stating the reason for the extension of the deadline as well as the expected time for a response.
       
    5. The person making the complaint will be informed of the handling of the complaint by e-mail, to the e-mail address provided in the complaint.
       
  8. Final provisions
    1. In matters not covered by these Terms and Conditions, the provisions of the Terms and Conditions for Publishers and the provisions of applicable law shall apply accordingly.
       
    2. Any disputes between the User using the Website Booster service and the Service Provider will be resolved amicably and, in the absence of an agreement, will be referred to the court having jurisdiction over the Service Provider's registered office.
       
    3. The Service Provider is entitled to make changes to these Terms and Conditions for important reasons. The Service Provider shall inform the Publisher of changes to the Terms and Conditions at least 7 days in advance, by sending an e-mail to the Publisher's address indicated at the stage of creating an account on the Platform and by means of the Platform's functionality.
       
    4. Placing an order and using the Website Booster service is only possible after reading these Terms and Conditions and declaring your acceptance of their contents.
       
    5. The regulations enter into force on 24.07.2025.
