Terms and conditions of the "Tier2 links" service available to Advertisers on the WhitePress platform®
General provisions
These Terms and Conditions set out the terms and conditions of the Advertiser's use of the service for the purchase of Tier2 links to the main publication ordered by the Advertiser via the WhitePress Platform (hereinafter: Tier2 Links).
The Tier2 Links service is offered by WhitePress Publishing LTD a limited liability company with its registered office in the United Kingdom, with registered office at 590 Kingston Road, SW20 8DN London, United Kingdom, registered under the entry number: 12339845, TAX ID No.: 348918847.
Unless otherwise stated herein, the capitalized terms listed below shall have the following meanings:
Business day – any day of the week from Monday to Friday, excluding public holidays.
Lead Publication – a sponsored article or expert guest article within the meaning of the Advertiser's Terms and Conditions, which is the subject of the Advertiser's order on the Platform.
Terms and Conditions – these "Terms and Conditions of the "Tier2 Links" service available to Advertisers on the WhitePress Platform® ".
Terms and Conditions for Advertisers on the WhitePress Platform® – document regulating the terms and conditions of use of the Platform and ordering the services made available on the Platform by Advertisers, available HERE .
Complaint – the procedure by which a Claimant makes a claim relating to the non-availability or inadequate provision of the Tier2 Links service.
Advertiser – a User of the Platform who is an entrepreneur, whose situation is governed by the Advertiser Regulations.
Platform – the WhitePress Platform owned and provided by WhitePress Sp. z o.o. at: www.whitepress.com.
Contract – a contract for the provision of Tier2 Links by WhitePress to an Advertiser, concluded between the Advertiser and WhitePress, under the terms and conditions set out in these Terms and Conditions.
WhitePress – WhitePress Publishing LTD a limited liability company with its registered office in the United Kingdom, with registered office at 590 Kingston Road, SW20 8DN London, United Kingdom, registered under the entry number: 12339845, TAX ID No.: 348918847.
Fee – the fee paid by the Advertiser to WhitePress for the provision of the Tier2 Links service.
WhitePress provides electronic services to users of the Platform on the basis of distance agreements between the user and WhitePress. These Terms and Conditions constitute the terms and conditions for the provision of electronic services.
The conclusion of a contract for the use of the Services provided by WhitePress referred to in section 4 above is possible on the condition of having a PC, Mac or similar computer connected to the Internet, equipped with an operating system (Windows, Mac OS, Linux or similar) and a web browser (Internet Explorer, Firefox, Chrome, Opera, Safari), as well as access to an e-mail account.
The services provided by WhitePress on the Platform are intended for people who use these services for the purposes of their own business and, at the same time, are of a professional nature for them. Whenever a User who is a consumer or an entrepreneur for whom the use of the services provided by WhitePress is not of a professional nature (so-called quasi-entrepreneur) wishes to make use of the services provided by WhitePress via electronic means, contracts with respect to the services provided by WhitePress electronically shall be concluded with them on terms and conditions agreed individually, the reservation that the provisions of the Terms and Conditions and the documents to which the Terms and Conditions refer shall apply to such Advertiser with respect to prices and, depending on individual arrangements, respectively with respect to the rest.
Tier2 links service
The Tier2 Links service is provided to enhance the main Publication ordered by the Platform by sub-linking it using external Tier2 links.
As part of the ordered service, WhitePress carries out, on behalf of the Advertiser, the publication of additional, newly created articles in which Tier2 Links are placed, directing to the Main Publication.
Additional articles created for the purpose of providing the Tier 2 Links service may be created: (i) using AI tools, e.g. Senuto Writer, (ii) by entities acting as WhitePress partners in specific markets. Additional articles are thematically matched to the Main Publication.
Tier 2 links in additional articles are placed in the form of an anchor identical to the URL or in the form of a thematic anchor, matched to the topic and SEO parameters. One additional article contains one Tier 2 link to the Main Publication.
Additional articles created for the purpose of the Tier2 Links service are published exclusively on portals belonging to the private network of WhitePress® partners, for a period of 36 months, subject to clause. 2.6 of the Terms and Conditions below. The Service Provider is not responsible for the subject matter or content of the partner portal on which the Additional Article containing the Tier2 Link is published, directing to the Main Publication.
Tier2 links are active for the duration of the availability of the Main Publication from the date of its publication, unless the Main Publication ceases to be visible on the portal on which it was published in accordance with the Advertiser's order before the expiry of this period. The preceding sentence covers in particular, but not exclusively, the cases of non-visibility of the Main Publication for the reasons set out in secs. 5.25 and 5.26 of the Terms and Conditions for Marketers on the WhitePress Platform. In such a case, the Service Provider is not responsible for the visibility of Additional Articles and the continued maintenance of Tier2 Links.
The DR rating of the affiliate portal indicated in the offer is valid up to 30 days back and is determined using Ahrefs. The provider does not guarantee that the DR index of the affiliate portal will be maintained in the period after the publication of the additional articles.
The visibility index indicated in the offer is valid up to 30 days back and is determined using the Ahrefs tool. The provider does not guarantee the maintenance of the visibility index, meaning the value of organic traffic in the period after the publication of additional articles.
Order processing
For the ordering process and the execution of orders for the publication of additional articles containing Tier2 Links, the provisions of clause 4 and clause 5 the Terms and Conditions for Marketers on the WhitePress Platform, subject to the following provisions of Section 3 of the Terms and Conditions.
Supplementary Articles with Tier2 Links are published within 7 working days from the date of approval of the Main Publication by the Advertiser via the Platform.
The Advertiser is not entitled to comment on the content of additional publications, with the reservation of a situation in which the Advertiser reports an error with regard to a link placed in an additional publication. In such a case, the Service Provider shall make the appropriate changes within 3 working days.
Additional articles with Tier2 Links are published on WhitePress partner portals. The Service Provider does not guarantee the thematic compatibility of the portal on which the article containing the Tier2 Link is published with the subject matter of the Main Article, and this fact is not a basis for comments or complaints by the Advertiser.
The Tier2 Links service is only provided in respect of the Main Publication for which it has been purchased.
Upon the purchase of the Tier2 Links service by the Advertiser, a Contract is concluded between the Advertiser and WhitePress on the terms and conditions set out in these Terms and Conditions.
Amount of the Fee
The Tier2 Links service is chargeable.
The amount of the Fee is determined by WhitePress and depends on the package/options selected by the Advertiser, the descriptions of which, together with the detailed parameters and the amount of the Fee, are visible to the Advertiser on the Platform.
The amount of the Fee is visible to the Advertiser on the Platform at the ordering stage.
The Advertiser shall be liable for all breaches of these Terms and Conditions and the terms and conditions of the Contracts entered into on the basis of the Terms and Conditions, as well as for non-performance or improper performance of the Contract entered into on the basis of the Terms and Conditions.
WhitePress uses reasonable endeavours to ensure that the Services provided are available at all times, at all times, but does not warrant and is not responsible for the full availability of the Services provided and reserves the right to change, withdraw, suspend or discontinue any feature or function of the Services provided to any extent and at any time. The modification, withdrawal, suspension or interruption of any feature or function of the services provided does not require any prior announcement.
The Advertiser may not order, through the Platform, a Main Publication or Tier2 Links to a Main Publication for the advertising of products or services whose advertising is not permitted under the generally applicable legislation or for the advertising of which the applicable legislation provides any restrictions, resulting in the illegality of the publication ordered. The proviso indicated in the preceding sentence excludes the use by the Publisher of the Platform and the Services offered by the Service Provider to publish content promoting products and services whose advertising and promotion is unlawful, such as but not limited to: gambling, alcoholic beverages and tobacco products, psychoactive substances, narcotics, medicines and other pharmaceuticals, services for the disposal, acquisition or mediation of transactions for the disposal or purchase of cells, tissues and organs, medical services, services of lawyers, solicitors, notaries and other professional groups covered by the advertising ban. In the event of a breach by the Advertiser of the above provisions of sec. 13.11, para. 13.18 and para. 13.19 of the Terms and Conditions for Marketers on the WhitePress Platform shall apply.
WhitePress shall not be liable for any damage caused by improper use of the services, in particular caused by the use by the Advertiser or other Users of the Platform of services provided by WhitePress contrary to the provisions of these Regulations.
WhitePress shall not be liable for the non-performance or improper performance of the concluded Agreement if it is due to events that WhitePress, in the exercise of due care, could not have foreseen or prevented, as well as due to fortuitous events and force majeure.
WhitePress is not responsible for the effects of the Advertiser's use of the services offered by WhitePress, which means in particular that WhitePress does not in any way guarantee the effects in the form of an increase in the Advertiser's revenue or provide any guarantee of achieving a certain level of turnover from the Contracts concluded.
Any Complaints regarding the Services provided by WhitePress under these Terms and Conditions should be made by email, to: .
The complaint should include at least: the date and time of the event that is the subject of the complaint, the e-mail address of the complainant and a brief description of the objections raised.
Complaints will be processed within 14 days after receipt, in order of date of receipt.
If it is not possible to meet the aforementioned deadline, the Service Provider shall inform the person making the complaint, stating the reason for the extension of the deadline, as well as the expected time for responding.
The person making the complaint will be informed of the manner in which the complaint will be handled by email, at the email address provided in the complaint.
Any disputes between the Advertiser and WhitePress will be resolved amicably and, in the event of disagreement, will be referred to a court having jurisdiction over the registered office of WhitePress.
WhitePress shall have the right to amend these Terms and Conditions for valid reasons. The Advertiser will be informed of changes to the Terms and Conditions at least 7 days in advance by sending information about the change to his/her email address provided within the Advertiser's account on the Platform.
The Rules of Procedure enter into force on 02.08.2024.
